Version 2026-10-12, effective from 12 October 2026
These terms and conditions apply to the salons (businesses) that use MyWest, a service of AIFAIS B.V., Mercuriusweg 25-27, 2741 TB Waddinxveen, the Netherlands, Chamber of Commerce (KvK) no. 42036293 (“MyWest”, “we”). These terms and conditions are intended solely for traders acting in the course of their profession or business. They are not consumer terms, and the statutory rules that specifically protect consumers (such as the right of withdrawal) do not apply.
How it works, in short:
1. You create a free account and use MyWest for 14 days without a payment method.
2. If you want to keep working after the trial, set up a mandate or a card via Subscription at the latest by the time the trial ends; without that, access stops after the trial.
3. After the trial period (day 15), the subscription starts and you pay monthly in advance.
4. If something is wrong with an invoice, report it within 14 days and we will resolve it.
5. You can cancel at any time; the articles below set out the details and what happens if an invoice is unexpectedly left unpaid.
In case of any discrepancy, the Dutch version prevails.
MyWest is software as a service (SaaS) with which a salon manages its calendar, customers, till, services, staff and subscription, accessible via a browser and via its own customer page for online booking. MyWest is not an accounting firm, a tax adviser or a staffing agency: the Salon remains responsible for its own bookkeeping, tax filings and obligations as an employer. We supply the software; the Salon uses it for its own business operations.
When creating an account, the Salon provides accurate information and keeps it up to date, in particular name, address, Chamber of Commerce number and, if applicable, VAT number. The Salon is responsible for keeping its login details confidential and for everything that happens through the account, including by staff that the Salon itself invites. MyWest may refuse or block an account in the case of incorrect information, misuse of the service, or persistent non-payment.
A new account gets 14 days of free access to MyWest, without a payment method being required for that.
If the Salon wants to keep using MyWest after the trial period, it sets up, at the latest by the time the trial period ends, via Subscription, a mandate for automatic direct debit, or sets up a valid card, as described in article 6. Without a valid mandate or card by the time the trial period ends, access to the account stops.
If the Salon sets up a mandate or card in time, the subscription starts and is invoiced monthly in advance. The first charge takes place on the day after the trial period ends (day 15), for the first payment period of the subscription, unless the Salon has cancelled before that date as described in article 11. From that moment the subscription continues and is invoiced monthly in advance as described in article 6.
MyWest offers three subscriptions. There are no set-up costs.
Staff members count as long as they are set to active in MyWest. The messages to My Westie apply to the whole salon per calendar month; unused messages expire at the end of the month. A salon that uses MyWest free of charge has the limits of Goud.
During the trial period of Article 4, the salon uses the subscription it has chosen, free of charge. After the trial period, the amount of that subscription is collected.
During the trial period the salon can send a total of at most 50 messages to My Westie, regardless of the subscription chosen. After the trial period, the monthly messages of the subscription apply.
A customer page of its own with its own photos, colours and texts and the Social media function are part of Zilver and Goud. The salon's booking page itself is part of every subscription.
Upgrading to a larger subscription is possible at any time via Billing and takes effect immediately. For the rest of the period already paid, the price difference is collected once, pro rata for the remaining days, with a separate invoice. The amount is shown in the confirmation window before the salon confirms and in the confirmation e-mail; this counts as pre-notification of this collection. From the next collection date, the monthly amount of the new subscription applies.
Downgrading to a smaller subscription takes effect on the next collection date; until then the current subscription remains in force and nothing is refunded. Downgrading is only possible if the number of active staff members fits within the smaller subscription.
We announce a price change at least 30 days in advance by e-mail; it applies from the first billing period after that notice period. If the salon does not agree, it can cancel free of charge until the effective date, as described in Article 11.
Invoicing is monthly and in advance, for the current payment period. VAT is charged on the price in accordance with the regime that applies to the Salon's country: Dutch VAT for a Dutch salon, or, for a salon in another EU country with a valid VAT number, the reverse charge (the Salon accounts for the VAT itself in its own country). The applicable rate or the reverse charge notice appears on every invoice.
The default payment method is automatic direct debit via Mollie: SEPA direct debit, iDEAL, Bancontact or a comparable method, depending on the Salon's country, or a card payment where automatic direct debit is not available. If the Salon wants to keep using MyWest after the trial period under article 4, it grants this mandate via Subscription, at the latest by the time the trial period ends.
At least 5 days before each automatic debit, MyWest sends the Salon a pre-notification by email stating the amount, the debit date, the mandate reference and the creditor identifier (NL08ZZZ502057730000). The Salon and MyWest agree on this period of 5 days instead of the standard period of 14 days under the SEPA rules. If a debit takes place immediately upon activation or an upgrade, the amount the Salon sees and confirms in the confirmation window counts as the pre-notification. The debit appears on the bank statement as "Mywest via Mollie".
If a debit fails, MyWest does not automatically debit the same amount again. The Salon then pays the invoice via the payment link in the email or under Subscription. If the account is locked as described in article 9, automatic debiting stops until the outstanding invoice has been paid.
The payment term is 14 days from the invoice date. This is a strict deadline: if that term expires without full payment, the Salon is automatically in default from the following day, without any separate reminder or notice of default being required. Article 7 sets out the consequences of default.
If a direct debit is reversed (charged back), the invoice amount remains payable in full: a chargeback does not settle the debt and does not count as payment. MyWest charges EUR 15.00 in administration costs for a chargeback, in addition to the invoice amount.
After a chargeback, MyWest no longer uses the mandate. If the Salon wants to continue with MyWest afterwards, it grants a new mandate via Subscription.
If the Salon withdraws its mandate, every payment obligation already incurred and every payment obligation still to be incurred remains fully in force. Upon withdrawal, MyWest automatically switches to payment by payment link, with the same payment term and the same consequences in the event of default. If the Salon does not set up a new valid payment method, MyWest may lock the account as described in article 9.
If the Salon is in default as referred to in article 6, it owes the following from that moment, without further notice:
These amounts are a contractual arrangement between businesses and exceed the statutory minimum that applies to consumers. If this contractual arrangement proves unenforceable in a specific case, the statutory minimum compensation for late payment of the country where the Salon is established applies instead as a floor: for the Netherlands the statutory WIK scale, for other countries the fixed amount named in the country annex to these terms for that country. This provision does not affect MyWest's right to claim the actual damage suffered instead, if that is higher.
A payment by the Salon is applied, regardless of any other designation by the Salon itself, first to outstanding collection costs, then to interest, and only after that to the principal sum, starting with the oldest outstanding invoice. A partial payment or a payment made “under protest” does not constitute settlement of the full amount and leaves the remainder, including the interest continuing to accrue on it, fully payable.
Before MyWest actually charges the collection costs referred to in this article or transfers the file to a collection agency, it sends the Salon a written final reminder stating the outstanding amount, a payment term of 14 days, and the amount of collection costs that will become due after that term expires. This reminder is not a condition for default to occur or for statutory interest to start running (that already happens under article 6), but it is a condition for actually charging the collection costs.
A claim by MyWest becomes time-barred as provided by law (in the Netherlands, five years after the invoice date, article 3:307 of the Dutch Civil Code). Every written reminder or notice that MyWest sends to the Salon interrupts this limitation period and starts a new term.
The Salon may not set off a payment to MyWest against a claim it believes it has against MyWest, and may not suspend its payment because of a complaint, a dispute or an alleged shortcoming. If the Salon believes it has a claim against MyWest, it reports this in writing; MyWest assesses the report and only pays or sets off after its own written confirmation of that claim.
If an invoice remains unpaid after the payment term of article 6, MyWest may restrict (lock) access to the account until payment has been made in full. This suspension does not release the Salon from its payment obligation and does not give any right to a reduction, set-off or refund. The Salon's data simply remains stored during a suspension: nothing is lost.
If an invoice remains unpaid after the final reminder of article 7, MyWest may transfer the entire file (agreement, invoices, reminders and proof of use) to a collection agency, a bailiff or a lawyer, without any further notice being required beyond the reminder itself.
If the Salon wishes to dispute an invoice, it reports this within 14 days of the invoice date with a clear reason: via the "Dispute invoice" button next to the invoice under Subscription, or by email to info@mywestapp.com. MyWest responds within 2 working days.
While a dispute reported in time is ongoing, MyWest sends no reminder or final notice for that invoice, does not lock the account for it and does not debit the disputed amount again.
If the Salon reports nothing within that term, the invoice is considered final and it no longer has any right to a credit. The undisputed part of an invoice remains fully payable in any event. The Salon's right to have a SEPA debit reversed by its bank remains unaffected; article 6 describes the consequences of a chargeback.
The Salon may cancel the subscription at any time under Subscription in the app, effective at the end of the current, already paid month: no further charge or invoice will follow after cancellation. No refund is given for the current, already paid month.
If the Salon cancels during the trial period under article 4, before the first charge takes place on day 15, no charge takes place at all; the mandate lapses and the account is terminated on the cancellation date.
MyWest may terminate the agreement with 14 days' notice, and with immediate effect for a valid reason, such as persistent non-payment, fraud, misuse of the service or a serious breach of these terms.
After the subscription ends, MyWest retains the Salon's data for a further 90 days, so that the Salon can easily reactivate its account. After that period, the data is deleted or anonymised, except for what MyWest is legally required to retain, in particular the accounting records relating to invoices (7 years, statutory fiscal retention obligation).
At the Salon's request, MyWest provides an export file of its customer and business data, so that the Salon is never locked in to MyWest to access its own data.
The Salon is itself responsible for the customer data it processes in MyWest: that it has a legal basis for doing so, that it informs its own customers about the processing of their data, and that it complies with the GDPR in its own business operations. MyWest processes this data on behalf of the Salon, as described in the data processing agreement that forms part of this agreement.
Our systems record when a salon has agreed to these terms, the data processing agreement or a direct debit mandate. Of the text that the Salon saw when giving its agreement, we retain a digital fingerprint (hash), the time, the IP address and the browser used, so that it can be shown at any later time that the text displayed is identical to the text the Salon agreed to. This record serves as proof of agreement between MyWest and the Salon, unless the Salon proves otherwise.
When creating an account, and each time a new version of these terms takes effect, the Salon confirms with a checkbox that it agrees to these terms, the data processing agreement and the privacy policy. This checkbox counts as signing these terms. After ticking it, the Salon can find and download the accepted text at any time in the account under Subscription, Documents.
Arrangements that deviate from these terms are only valid if MyWest has confirmed them in writing (by email from its own business address). A verbal commitment, or a statement in a chat or phone call, does not bind MyWest without that written confirmation.
MyWest is not liable for damage arising because the Salon misuses the software, or because the Salon does not check its own data before using it (for example, for an invoice to its own customer).
MyWest's total liability towards the Salon is limited to the amount the Salon has paid to MyWest in the 3 months preceding the event. MyWest is not liable for indirect damage or consequential damage, including lost revenue or profit. These limitations do not apply in the case of intent or wilful recklessness on the part of MyWest.
All rights to the software, the MyWest brand, the source code, texts and design belong to AIFAIS B.V. The Salon is granted only the right to use the software for as long as the subscription runs; it may not copy, reproduce, decompile or resell the software.
MyWest makes an effort to keep the service available but does not guarantee uninterrupted operation. Maintenance, disruptions at suppliers (such as the hosting provider, the database provider or the payment service provider) and force majeure may lead to temporary unavailability; this does not give rise to any right to compensation, discount or refund.
MyWest may amend these terms. We announce an amendment at least 30 days in advance by email, with the new text and the date on which it takes effect. If the Salon does not agree, it can cancel free of charge until the effective date, as described in article 11. If the Salon does not cancel and continues to use MyWest after the effective date, the new version applies automatically. The version the Salon agreed to remains available under Subscription, Documents.
These terms and every agreement between MyWest and the Salon are governed exclusively by Dutch law.
Disputes that are not resolved by mutual agreement will, to the extent permitted by law, be submitted exclusively to the competent court in The Hague. Where a claim must by law be brought before the cantonal court (in practice, virtually every claim by MyWest against a salon), article 108(2) of the Dutch Code of Civil Procedure provides that this choice of forum does not apply; in that case, proceedings are brought before the court of the Salon's place of residence.
If a provision is invalid, the remaining provisions remain in effect and the invalid provision is replaced by a valid one that comes as close as possible to it in substance.
